CAT unanimously rejects raptures EPG appeal

The Competition Appeals Tribunal (CAT) has unanimously dismissed the appeal by Rapture against a ruling by Ofcom, which concluded that charges levied by BSkyB for the provision of electronic programme guide (EPG) services between November 2005 and November 2006 were fair, reasonable and non-discriminatory. Rapture claimed that Ofcom did not conduct a thorough investigation; erred [...]

Monday round-up: Byron Review; Tory-slicing the BBC; Kip Meek; farewell to Miami Beach…

Folks, I’m sick to death of this warm and sunny beach scene — ready to return to Oxford via LHR Terminal Five!
– The whole Byron Review was published. Really, I was fairly impressed with both the Byron Review, and with Ofcom’s response. If I recall correctly Dr. Byron will appear before the Select [...]

Folks, our only hope is being developed in Texas:

ippr: ‘a generation of youth subjected to pointless social research’

ippr: ‘a generation of youth subjected to pointless social research’

Actually, I think the headline was they were being ‘raised online’.
Anyway, the ippr want the following:

Charlie Beckett’s criticism of the ippr is dead-on. These are undoubtedly well-intentioned but ultimately unworkable (and probably dangerous) recommendations. Think about it: the government and Ofcom are challenged already in the regulation of the state-owned broadcasters — the [...]

Mobile Regulations and Competition Law Conference 2008

Mobile Regulations and Competition Law Conference 2008

Folks, another great one from our friends at VIB Events…

(click on the logo above for registration details)
Ofcom’s very own David Stewart is one of the speakers. There is even a presentation called ‘the waterbed effect’ by a firm called Copenhagen Economics. I can’t wait to see what that is.
With my mobile provider, it’s more [...]

An old mutt with mange or the Uk’s telco regulator

It’s been a long (since rock ‘n’ roll …) erm, sorry, since the Fighting BT Wholesale Blog was updated, but the anon person from a UK ISP is back and sharing his love for our Regulator…
“Ofcom is of course the telecoms watchdog. However as far as watchdogs go, Ofcom are the toothless old mutt with [...]

Clear as …

The Government have responded the the crystalclear petition on broadband speeds.  ”We the undersigned petition the Prime Minister to instruct Ofcom to force ISPs to advertise a typical rate for broadband subscriptions, not just a theoretical ‘maximum’ rate.”
Response:
The Advertising Standards Authority (ASA) is the advertising industry body responsible for regulating the way in which Internet [...]

High speed broadband — mostly a scam — Ofcom’s role?

The Daily Mail reports today:
‘Ninety-six per cent of internet users with ultra high-speed broadband packages are not getting what they pay for, according to a study.
Experts today called for the telecoms regulator Ofcom to investigate.
Researchers analysed the broadband speed received by 4,000 internet users signed up to Britain’s six biggest providers: BT, Virgin Media, Carphone [...]

Online TV: Joost vs. Hulu

Online TV: Joost vs. Hulu

Hulu.com ended its beta test period and was released to the U.S. public yesterday. For now, I think it is only available in the U.S. The list of programmes (NBC Universal / Fox) is a good start, but not yet a total solution. HBO, for example, does not put its content on [...]

Ofcom’s Ed Richards on the 2nd Public Service Broadcasting Review…

Ofcom’s CEO, Ed Richards, yesterday delivered an interesting speech to the Royal Television Society. His full remarks are here. The best nuggets, along with my reactions:
Ofcom: ‘And for the first time since its inception the balancing act at the heart of a publicly owned commercial PSB – Channel 4 – is in [...]

George Bush on ‘due impartiality’ (the so-called U.S. fairness doctrine)

George Bush rarely makes reference to media policy, but he did yesterday, attacking Congressional attempts to restore what used to be called the fairness doctrine. The fairness doctrine had roughly the same effect as the due impartiality rules enforced by Ofcom. Here is a portion of Bush’s remarks (the full speech is here):
‘[T]here’s [...]

OfcomWatch: Lessons from five years of Ofcom watching…

I think we’ve hit the 5-year mark — 11th of March 2003 — the date OfcomWatch went live on the web (we moved it over to the blog platform a few months later). Luke and I were graduate students at the LSE — in a media regulation programme. OfcomWatch was an idea that was [...]

Will Hutton on Channel 4: proper diagnosis, terrible remedy…

Folks, there was an interesting piece by Will Hutton in the Observer on Channel 4 and its financial future. He writes in part:
‘Britain does have its homegrown hits – Torchwood, Mistresses, Cranford, Shameless, Footballers’ Wives – but, given the huge demand, they are thin on the ground. Too many of the successes are adaptations [...]

Media and comms — the consumer experience: U.S. compared to U.K.

Coming back to the U.S. for an extended period of time this month made me want to share some differences in the consumer experience. All anecdotal and highly subjective, of course:
– TV in the U.S. is both better and worse. The stand-out is local news and weather. The local Miami station here [...]

The future of television: bulls versus bears

I thought I would have some fun today and highlight two different views of the future of television. Both come from the annual reports of respected broadcasters that provide entertainment, PSB, news and sports. A free cocktail at the Delano to the first person who can tell me which statement comes from the [...]

Broadband: It’s hotter — and faster — in Miami Beach

Folks, while I am on holiday I thought I would do a quick broadband speed check. Regardez:

Maybe Ofcom can send a team down to meet with the Florida Public Service Commission to see how telcos can deliver these speeds in a hurricane zone with art deco-era housing stock. The Florida PSC are really [...]
