Ofcom’s head of legal talks to the lawyer
Today’s issue of The Lawyer has an interesting interview with Polly Weitzman, head of Ofcom’s legal team, in which she predicts more battles between Ofcom and the Competition Appeal Tribunal (CAT) as companies and lawyers test the limits of the new laws. So far the CAT has remitted aspects of Ofcom’s decisions back to the regulator twice in four Competition Act cases, and once in six Communications Act cases. Weitzman is quick to point out that the CAT hasn’t overturned an Ofcom decision yet. “It’s right and proper that our decisions are scutinised and that people have the right to appeal our decisions. When there’s ambiguity, the Courts need to clarify the position as to the law. We expect that, in making important decisions, they are sometimes going to be controversial, and we’re not frightened of doing that so long as they’re soundly based”
