Ofcom to broaden enforcement of 070 numbers (Personal Numbering Services) acceptable use rules

Ofcom published today a consultation on a proposed amendment to its Guidelines on acceptable use of 070 numbers (the ‘Guidelines’).

070 numbers are designated solely for Personal Numbering Services (PNS). PNS allow end-users to be contacted via a single telephone number, regardless of location, and to receive these calls at almost any telephone number, including mobile numbers.

The Guidelines include the definition of PNS and Ofcom’s criteria for assessing whether a service falls outside or within the scope of this definition.

Examples of services that Ofcom would consider to be legitimate PNS include:

  • 070 numbers allocated to end-users who frequently travel and wish to be able to receive calls in different locations
  • 070 numbers allocated to users of internet dating sites, chat rooms, etc., who want to be contacted by other users of these websites without disclosing their ‘regular’ phone numbers
  • 070 numbers allocated for the purpose of selling through classified ads in magazines

Examples of uses that may be unacceptable for 070 numbers include:

  • services allocating 070 numbers with the intention that the calling party shall set the number called, rather than the receiving party
  • switchboard services through which more than one end-user can be contacted through a single 070 number
  • services allocating 070 numbers for the purpose of making international phone calls (as opposed to receiving such calls)
  • the use of 070 numbers for administration of individual 070 numbers

Ofcom�s policy to date in enforcing the proper use of 070 numbers has been to focus on the communications provider to which the relevant number range was allocated. This is mainly because it enables Ofcom to easily identify (from the National Numbering Scheme) the communications provider that has been allocated the telephone number in question and to take action with regards to any misuse.

Accordingly, Ofcom emphasised in the Guidelines the responsibility of the number range holder where sub-allocatees or resellers of PNS are not complying with the acceptable use rules. However, Ofcom now notes that it has become clear to Ofcom that there may be a number of communications providers seeking to avoid the restrictions on the use of 070 numbers by offering services via numbers obtained from a series of different number range holders. Ofcom further notes that it has become aware of some examples of �shopping around� by those apparently seeking to circumvent the restrictions on the use of 070 numbers, with some communications providers simply switching between range holders when the misuse has been detected. Ofcom believes that such behaviour by an apparently small number of communications providers undermines the integrity of the number range and is detrimental to both range holders and consumers.

Ofcom now proposes to amend the Guidelines by adding to the Guidelines a section headed ‘Responsibility for sub-allocated numbers’, which clarifies that the restrictions on use of 070 numbers apply equally to the number range holders and to communications providers other than the number range holder using the 070 number, requiring both the range holder and any such other communications provider to take all reasonably practicable steps to secure compliance by their customers (without this reducing any of the obligations on the range holders themselves).

Ofcom invites written comments on the issues raised in this consultation, which may be submitted to Ofcom by 8 November 2005.

    This 070 scam must change. Most people, myself included, presumed that this was a mobile number. The telephone bill reflected otherwise.
    Regulation is about clarity and there is none whatsoever here. Ofcom must act, and ensure that the number is associated clearly with a premium rate.

    I was scammed on my mobile. A text message received 6.Jan.06 said I was called on +44709680852 but the caller had left no message. When I called back next day I got a recorded message from the scam operator stating the number was no longer in use and inviting me to visit www.privacynumbers.com which I haven’t because it could be a virus-loaded site. Please shut these numbers down.

    I have been victim of unsolicited premium rate SMS/ calls and although
    I registered with TPSonline etc, I recently have received a missed call from (Xero 9 limited) I am fed up and
    fuming that these companies are allowed to be set up, they provide
    useless/ unrequired services, in the case of Xero 9 Ltd, this company

    is doing daylight robbery & fraud. I recieved a 1 bell, missed-call from this firm on sat 25/2/06, 1500, the number left on my mobile was
    ‘0709680735′ ,upon initial inspection this looks like a mobile number

    and when I dialed to check who it was, I was presented with a short, 5 second automated message of useless data. For this call I was charged �1.05.

    These firms must be shut down and forced to re-imburse stolen money from us victims.

    I’ve been scammed too, as have many of my friends and colleagues. I would prefer my mobile operator (Orange) to filter out ALL 070 numbers, but they are unable to do this at present.

    I heard a short message directing me to privatenumbers.com. I’ll be preety narked if it shows up as much on my bill!

    Surely it’s not legal if they are blatently relying on people to assume it’s a missed call from a mobile. I have no problem calling mobiles back when I receive a missed call as my tarrif allows me to do so free, and I’m sure there’s loads of people out there in the same situation. These scammers should be stopped, it’s theft/fraud in my opinion!

    If someone calls and doesn’t leave a message I don’t bother with it. As far as I am concerned, if it is important they’ll call back.
    That said, this practice is reprehensible, and should be knocked on the head as soon as possible I think it’s disgusting that people should be made to pay for scams like this. Shut them down, Ofcom, and do it quickly.

  21. privacynumbers.com isnt a virus site, i bin on iy. infact i use it. the reason its not illegal is because its usefull. it you tend to give your numbers out to people then you get one of these numbers and then if you decide you dont want to answer you just go on the site and cancel the account.

    Both me and my wife have received missed calls from these 070 numbers (mine was 07089702146) over the weekend (22nd and 23r April 2006). This thread was started in 2005. Is anything being done to stop these people???. It is obviously stealing. Maybe you should confiscate their revenues from these numbers and hit them where it will hurt the most…

    I’ve just had a prerecorded scam message left on my landline answerphone where a guy with a Lancashire accent asked me to call back about a digital camera on 07012907452. I didn’t of course - but according to ICTIS website they won’t take a complaint from me as “they do not regulate this type of number”. The site does say the number is provided by Band-X limited.

    dang! have just been scammed… had my phone on silent so didn’t know how long it rang for - saw I’d missed a call and as I was awaiting a phone call dialed the number. Someone actually answered - a promo company ‘£600 free travel vouchers’ at which point I hung up. No idea about the 070 number thing so googled it and arrived at this site. No clue how much the call will cost me (or rather the mobile co I work for!!)

    Scammed by privacynumbers, I phoned back 07096808071 as I missed the call and was charged about £1.50 having checked balance before and after calling.
    Message was to the effect “this number is no longer in use, go visit privacy numbers .com

    I never suspected an 07 number to charge a fortune. Do all 070 numbers charge like this? as I have associated 07 to be UK numbers and so charge at regular rates.

    They do not allow you enough time to pickup so that you will ring them back and pay them money without realising.

    This is clearly fraud and should be delt with appropriately.

    Similar to a poster above, I had a recorded message from a bloke called “Ben” with a Yorkshire accent, regarding delivery of a radio. The number, provided again by Band-X-Limited, was 0701 2903143.

    I’ve complained to Band-X-Limited, but, isn’t it about time something was done to stop these scammers!

    I just got a missed call from 07099851787. It’s happened a few times in the past. I called one of the numbers from work once and asked to be removed from their marketing lists. I realised that they were just trying to keep me on the phone and weren’t actually doing anything about my request. Can’t seem to find any contact details for the Switch Services Ltd apart from a company in Birmingham called Selector Switch Services Ltd 01543454554. If anyone finds another number for Switch Services Ltd please post here.

    I got in touch with switch-tele.com in Bristol, who were very good and put
    my mind at rest. They own the number but have shut the scammer using it down.
    They explained that his/her broadcasting equipment is still sending or broadcasting

  54. I just got called by 07099804744 - and as I had my phone in my hand at the time I answered it (not knowing anything about the 070 scam).

    I heard a guy then saying ‘hello? hello?? can you hear me?’ - even though the reception was as clear as a bell - and when I said I could, he hung up. I didn’t call back as I thought it might be a scam, and now I find that I was right!

    I hope I can’t get charged in some way for them to have actually got through to me??

  55. How to fight back 070 spam:

    - Go to http://www.icstis.org.uk (the premium rate services regulator)

    - Call them on 0800 500 212 to make a formal complaint about the number

    Then…

    - Look up (search box on ICSTIS’s homepage) who registered the 070 number and call them directly to complain if a contact number is displayed.

    - If only a company is shown then google it and find their website. Contact them through that to complain about the number.

    - Or more effectively, enter the company’s website address on http://www.whois-search.com and find out a real address or phone number of the person who registered the domain name. I have generally found that sometimes you get the Managing Director’s personal mobile number and address - who better to complain to!

    Please pass this on to all other 070 spam sufferers!

  56. Guys, I’ve had these before but you really need to put it into perspective.

    Firstly, there is no such thing as a £9 per min phone number.

    Second, there are over 1 million 070 personal number used by various businesses, usually plumbers and other tradesmen but also high street stores. In my town there is a computer shop that uses an 070 number as they managed to get one that spells out the name of thier shop on the telephone keypad.

    The amount of money these people get from the actual call charge is pretty small, if you have an issue paying 50p to call somebody you don’t know (your own fault in my opinion), take it up with BT. They issue the numbers and ultimately they benefit the most. Ever wonder why these ’scam artists’ aren’t getting thier numbers cut off by the people issuing them?

    The post from Charles McIver (April 17th) is wrong. BT don’t issue numbers, OFCOM does. The person who benefits the most from these calls is the person who receives the call, followed by Her Majesty’s Customs and Revenue. The phone companies receive about a penny a call and the mobile companies a bit more. The charges are published on the internet. OFCOM and the phone companies do take action against these people, they can stop the money going to them and do shut numbers down but they need enough complaints to make it reasonable to start investigating them and to support the action.

    Switch-tele/Switch Call Limited own 07099895589 and their customer is currently doing the ‘1 ring’ scam. Switch Tele can be contacted on 0845 652 2222 if you also want to complain.
    I suggested naming and shaming the person responsible. I’m not holding my breath.
    They promised a refund if you have been caught in the scam.

  65. I received a call whilst travelling home on my motorcycle. Obviously, being on the bike I was unaware of the call until I checked ny phone at home. The number was 07081700168. I called but got a ‘we are diverting your call’ message. This then rang for a few seconds before I hung up. I then went to send a text message saying ’sorry I missed your call’ but became suspicious when it failed to send. Checking my account (Orange PAYG), I was exceedingly miffed to discover my account was minus £1.00 for the call. In any other name this is theft. Who does these blinking things and why do the telephone providers allow it?

    Maybe they could use ID checks such as GB Group to confirm the owner of the number and have a deposit scheme to get our money back?

  69. I want to know how they get our mobile numbers in the first place. Ive carried out some research of my own. This website http://www.oncetel.co.uk/faqs.html says that you can use your mobile number to call a person to keep your number a secret from being received by the person you are calling. For instance your number is 07934343343 it will show up as a 07034323424 number. The number will last a week then disapear.
    In my opinion only whores would use this service. have sex with a stanger and then never get contacted again. if that person calls then he or she gonna pay bucks to the company providing the 070 number.

    I today have got 3 calls from this number 07017770000 asking to speak to my boyfriend as soon as I say he is not here can I help they just hang up. Happened 3 times today and I have called back but BT step in and say you have dialled a personal number this is not a mobile number and calls are charged at up to 50p a minute or 51p a minute from a BT Line.

    How do I stop this number or how can I call back and ask them what they hell they want????? my boyfriend has no idea who they are but they knew his name as they asked for him. Any ideas as to how they would have got our home number???

    Any help on this would be good as I am worried as to how and why these people are calling

  82. Maz, I just recieved a call from that same number (07017770000), and the guy on the phone was trying to give me a free mobile phone. He was very persistent even after I said no (many times). I asked him if he would be interested in such an offer, and then told him to get one for himself.

    There’s no doubt a scam in there somewhere. I’d advise people not to release any personal details to these people.

  83. I just found 07017770000 displayed by calls going through one or two VoIP or callthrough routes, so the person calling you is probably entirely legitimate, and just making a call via a cheap provider

    This morning I forwarded a couple of phone numbers and called one of my own phones, and that was shown; it seems to only happen on an interaction with 2 companies, not just the one, and only if no other ID was available.

  86. Got a 2 quid bill for 25 seconds contacting 0706 1740502 (Hot Chilli).

    Spoke to Icctis, who said we put a warning before calls now as a result of feedback. Whilst this is true on landlines, no warning is provided from a mobile. Spoke to Mobile company, who block outbound premium rate calls from this mobile. Was told this was not a known premium rate number, despite the call type being shown as “Premium Rate Numbers”.

    Would it be possible to:

    1) Change the numbers (Using a range of numbers for this service which start with the same prefix as a mobile, is going to create confusion)
    2) Extend warning messages on landlines to mobiles
    3) Ensure mobile operators are kept informed about Premium Rate ranges, and are able to block calls as customer requested.

    I am not sure how or why this number was called, and will be advising friends and family to avoid 070 numbers. Hope we get some action soon to prevent this happening to others, looks like its been going on for a while.

    Just had a missed call (1 ring) from 0706 1784594, I called back from a landline, had a warning saying if I was connected it would cost 50p per minute, gave me a chance to hang up though… obviously I did.

  91. Just had a call from 07017770000 to my landline, foreigh sounding gentleman with thick accent, who was outside somewhere walking, calling from a mobile, supposedly from a company called Global Telecommunications, selling mobile phone upgrade to a Nokia something or other.

    Pointed out that he’d called a land line not a mobile, so asked why would I be interested, and he cut the call.

    I also didn’t realise that 070 numbers were not mobile phone numbers until I searched the web and found this page.

    Received a call from 0707770000 today but unfortunately (or is it fortunately) didn’t reach the phone in time. If this is meant to be a personal number only according to the Ofcom guidelines - why would I get a call from it?

    I received a call that hung up after two rings! I without thinking, called the number back only to be told that they where trying to locate my caller! Naturally I hung up! These rogue companies that make these calls should be stopped!! How many complaints do OFCOMWATCH need to receive in order to put a stop to this sort of thing happening!!??

    I had one of these. Phone rings for about 1 second so that a Missed Call is displayed on the phone. I have no intention of calling 0706 1787364 back but I bet lots of other people do.

    Ofcom - Stand up for Rip-off Britain and take action against these scammers.

Also to let you know that it originates from a company called FleXtel - so I have complained to them as well about their client. Ictis have a number check on their website so you can find more information about the numbers - www.phonepayplus.org.uk.

I got one this monring, although more concerning, is that I have harassment charge on someone who is stalking me and now that allegations have been made I got a cll from an 070 number and am not able to find out if it was the scam or if he joined the service. The search tool says it is a personal mobile number and issued to a company called hot chilli. Thinking it as my stalker I phone hot chilli and will probably be charged for it…oh well. But am making a complaint and have added to my police report in the event that is is my stalker and another example of how these 070 numbers can be used.

  131. I had 3 from from 07061799256. I thought it was from a friend as they tried 3 times with 1 hour. I tried to call back with my landline but no response. I thought it was because they didn’t recognise my landline number so I put credit on my mobile and tried again. Same response, so I checked my credit and it had gone down by 85p! Even though there was no on to answer my call! What a scam. Please shut these scammers down!

    I have started receiving these god-awful things - from 07061 797557.

    I wouldn’t mind about the fact that they are scamming so much as interrupting my free time - I’ve had 3 calls in as many hours. I’m on 24 hr call so it’s not as if I can turn the damned thing off.

    Maybe if OFCOM don’t want to do anything about it they will decide to pay for every scam call that people receive through what is an obviously flawed system.

    Any calls from 0705 358 1250 are from a leased line via 7Tel Ltd (also associated with Firefly Telecoms).

    I’ve been through Ofcom and just logged this with http://www.phonepayplus.org.uk/ They’re not sure what’s going on with these 070 numbers but it’s worth logging.

I have absolutely no faith in either OFCOM or the British government who seem to allow every possible dirty trick to be played on consumers with the system of surreptitious premium rate call charges. All parties concerned seem to ignore the fact that they continue to create ways in which consumers may be tricked and effectively robbed.

    In the past I have found OFCOM to be unresponsive and useless. That seems to be the way of things in the UK and I feel that we need to begin to push these issues into European court to wake up the various cosy bureaucrats who seem to sit back and do very little.

    If you use these sites probably best to withhold your number an just use email until you are speaking with a real person.

    I just had a missed call this morning……no ringing! So I called it back from my land line and the number was 07036586600?? When I called, it rang then said it was transfering my call, then rang again and an answer phone message said, “This is ***** Livingstone I cannot take your call at the moment so please leave your name and contact number I will call you back”. The gap to leave a message cuts off after 30 secs, so you can’t leave a message anyway!
    I’ve also been getting calls from another number +27734868448. They hang up after ringing a couple of times. How b***dy annoying are these twats??

    Was expecting a call from my daughter today and knew she would probably ring from a friend’s phone as she hasn’t got her charger with her.

    So when I saw a missed call from 07061 758 711 thought it was from her and rang back - no answer.

    Didn’t know about this 070 thing until I googled the first part of the number. WHY IS THIS NOT PUBLICISED BY OFCOM TO THE UNSUSPECTING PUBLIC? It is a scam and the Government, OFCOM and the phone companies are just allowing it to continue. This service should be shut down IMMEDIATELY and anyone who has to travel or be contactable should just do what we all do and use the roaming facility their phone company provides. Now that is another pet hate, roaming charges……!

    i just got a missed call and it echoes that of all the posts above. i was expecting a call back from a friend and got one ring. I googled the number first before i called back because i didn’t recognize it’s origin and found all of this!! it’s been going on a while huh!
